These Terms and Conditions govern access to and use of the website operated under the name Stefania Capobianco and available at https://stefaniacapobianco.channel.markedev.com (the "Site"). The Site is operated by Stefania Capobianco, with registered address at PIAZZA DEI SATIRI 52, 00186 Roma (RM). For general enquiries, you may contact the operator by email at info@stefaniacapobianco.com.

The Site provides information about the operator's activities and offers visitors the ability to contact the operator and subscribe to a newsletter. Where the Site offers paid goods or services, separate terms and purchase confirmations will apply.

Use of the site — permitted use, accounts, accuracy of information

Permitted use: You may access and use the Site for lawful purposes and in accordance with these Terms. You must not use the Site in any manner that could damage, disable, overburden or impair the Site or interfere with any other party's use of the Site.

Accounts and credentials: Certain features of the Site may require you to create an account. When you create an account you must provide accurate and complete information and keep that information up to date. You are responsible for maintaining the confidentiality of any username, password or other credentials associated with your account and for all activities that occur under your account. You must notify the operator immediately of any unauthorised use of your account.

Accuracy of information: The operator takes reasonable steps to ensure that information on the Site is accurate and up to date. However, the operator does not guarantee the completeness, accuracy or reliability of any content and you acknowledge that information may change. It is your responsibility to verify any information before relying on it.

Orders, prices and payments

Where the Site offers goods or services for sale, the applicable product or service pages and any order form will describe the price, payment methods and applicable taxes. The operator may use third-party payment processors and services; where such services are used, they will be identified at the point of sale and you will be required to accept the third party's terms.

Payment information: If you make a purchase, you authorise the chosen payment provider to collect and process the payment details you provide. The operator does not store full payment card details on its servers unless explicitly stated in a purchase flow.

Pricing errors: In the event of a manifest pricing or typographical error, the operator reserves the right to refuse or cancel orders placed for the product or service affected by the error, even after an order confirmation has been sent.

Delivery, withdrawal and returns

Delivery: Where physical goods are sold via the Site, delivery terms and estimated delivery times will be provided at the point of sale. Delivery times are estimates only and subject to change.

Consumer right of withdrawal: If you are a consumer resident in the European Union purchasing goods or services remotely, you may have a statutory right to withdraw from a distance contract within 14 days from the day you (or a third party designated by you other than the carrier) take physical possession of the goods, without giving any reason. For services, the withdrawal period runs from the day of the conclusion of the contract.

Exceptions and commencement of obligations: The right of withdrawal may be limited or excluded for certain contracts under applicable law (for example for sealed goods which are not suitable for return for health or hygiene reasons if unsealed, or for bespoke items). If you expressly consent to immediate performance of a service before the end of the withdrawal period and acknowledge that you lose the right to withdraw, the operator will provide clear confirmation before you place the order.

How to request withdrawal or returns: To exercise any statutory withdrawal or to request a return, please contact the operator at info@stefaniacapobianco.com with details of your order and request. Refunds will be processed in accordance with applicable consumer protection rules and the operator's returns policy where provided.

All intellectual property rights in the Site, its design, text, graphics, images, logos, videos and other content are owned by or licensed to the operator, unless otherwise stated. You may view, download and print extracts from the Site for your personal, non-commercial use, provided you keep intact all copyright and proprietary notices.

No licence: Except as expressly provided in these Terms, no right, title or interest in any intellectual property rights is granted to you and all rights are reserved. You must not reproduce, modify, distribute, republish, exploit commercially or create derivative works from the Site content without the operator's prior written consent.

Liability and warranties

Disclaimer of warranties: The Site and its content are provided on an "as is" and "as available" basis. To the fullest extent permitted by applicable law, the operator disclaims all warranties, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose and non-infringement.

Limitation of liability: The operator's liability for direct damages arising out of or in connection with your use of the Site is limited to the amounts paid by you, if any, for the goods or services giving rise to the claim during the 12 months preceding the event giving rise to liability. To the fullest extent permitted by applicable law, the operator will not be liable for any indirect, incidental, special or consequential damages, loss of profit, loss of data or business interruption arising out of or related to these Terms or your use of the Site.

Nothing in these Terms shall exclude or limit the operator's liability for death or personal injury caused by its negligence, liability for fraud or any other liability that cannot be excluded or limited under applicable law.

Applicable law and jurisdiction

These Terms are governed by the laws of Italy and, to the extent applicable, European Union law. For any dispute arising out of or relating to these Terms or your use of the Site, the competent courts of Rome shall have jurisdiction, unless mandatory provisions of applicable consumer protection law provide otherwise for consumers.
